Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RV Technology Consulting ("Company," "we," "us," or "our"), the owner and operator of myMTree and the website mymtree.com (collectively, the "Platform" or "Service"). By accessing, registering for, browsing, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.

1. Platform Scope & Educational Purpose

No Financial Advice: myMTree is a software, research, and educational platform. The Company is not a Registered Investment Advisor (RIA), Broker-Dealer, Commodity Trading Advisor (CTA), or financial planner. Simulated Environment: All default accounts, bots, and academy sandboxes operate in simulated paper environments. No live market orders are executed on the Platform without explicit external broker integration and independent user approval. Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to access or use the Platform.

2. Account Registration & Security

Account Integrity: You agree to provide accurate, current, and complete information during registration and to update your details promptly if changes occur. Credential Protection: You are solely responsible for safeguarding your login credentials and API keys. You accept full responsibility for all activities that occur under your account. Immediate Notification: You must notify us immediately at support@mymtree.com upon discovering any unauthorized use or security breach of your account.

3. Subscriptions, Payments & Billing

Payment Processing: All payments, recurring subscriptions, and one-time fees (including the 12-Week Academy Cohort fee of $1,997) are processed securely through Stripe. By purchasing access, you authorize the Company (billed as RV Technology Consulting / MYMTREE.COM) to charge your payment method. Recurring Billing: Monthly subscription tiers (e.g., Autopilot Sandbox at $19/mo, Portfolio Audit Pro at $29/mo, Sentinel Desk at $99/mo) automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via the Customer Billing Portal (account.mymtree.com). Refund Policy — Digital Subscriptions: Monthly subscription charges are non-refundable once the billing cycle commences. Refund Policy — Cohort Programs: Due to immediate access to proprietary curriculum, algorithms, and sandbox compute resources, one-time enrollment fees are non-refundable once cohort credentials and materials are delivered, unless required by applicable law.

4. Prohibited Uses & Platform Integrity

You agree that you will not: • Reverse engineer, decompile, disassemble, or attempt to extract the source code, proprietary algorithms, consensus formulas, or model weights of myMTree. • Deploy unauthorized scrapers, crawlers, automated bots, or data-extraction tools against Platform endpoints. • Rent, lease, sublicense, resell, or redistribute any data feeds, signals, curriculum materials, or software licenses obtained through the Platform. • Interfere with or disrupt Platform infrastructure, Redis event buses, API endpoints, or connected networks. • Share paid account credentials across multiple individuals or external parties.

5. Intellectual Property Rights

All software, algorithms, factor engines, user interfaces, branding, trademarks, logos, audio/visual lessons, flashcards, and trade receipt designs displayed on mymtree.com are the exclusive intellectual property of RV Technology Consulting or its licensors. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access the Platform strictly in accordance with these Terms.

6. Disclaimers & Limitation of Liability

"As-Is" Provision: The Platform, data feeds, indicators, and tools are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. Exclusion of Damages: To the maximum extent permitted by law, the Company, its owner, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including, without limitation, trading losses, lost capital, loss of profits, data corruption, or system downtime — arising out of or related to your use of or inability to use the Platform. Liability Cap: In no event shall our total aggregate liability exceed the greater of $100.00 USD or the total amount paid by you to the Company in the twelve (12) months preceding the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless RV Technology Consulting, its affiliates, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your trading activities, or your violation of these Terms.

8. Governing Law & Dispute Resolution

Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without giving effect to conflict of law principles. Mandatory Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be settled by binding arbitration in Clark County, Nevada, administered in accordance with the commercial arbitration rules of the American Arbitration Association (AAA). Class Action Waiver: You agree that any proceeding shall be conducted exclusively in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action.
